Developer not filing suit over Oakhurst Dog Park property

The developer who wanted to buy part of the Oakhurst Dog Park from the Boys & Girls Club says he is not filing suit over the failed contract.

The deal fell through in May. The developer, Jay Weaver, says the contract was terminated. The Boys & Girls Club said in a statement that the contract simply expired in May.

Weaver Capital Partners intended to turn the land into single family homes. During the course of the debate over the park, the city of Decatur restarted conversations with the Club about purchasing the entire Boys & Girls Club site, with or without the dog park property.

The city’s involvement in discussions about purchasing property from the Boys & Girls Club was inappropriate, Weaver says, because at the same time, the city was also mulling over his subdivision request. Weaver had been looking into whether there was legal recourse against the Boys & Girls Club or the city of Decatur.

However, in an email, he told Decaturish, “We have decided not to pursue a suit at this point. We will continue to monitor the situation between the city and the Boys & Girls Club.”
